To improve your space, we suggest that you add more of a purpose for this space. In order to add more of a purpose you can provide to people of the theater with photo opportunities relating to the show. There should be more greenery in the space. Perhaps bring some popcorn vendors and places to get drinks. Perhaps also add seating during intermission.

Thank you for contacting us. If you were taking photographs of the building and its privately owned public space from the public sidewalk, then a security guard from the building normally should not be able to tell you that you cannot take photographs from that location.

I went to visit this POP this morning. I started taking pictures of the building from the outside when I arrived. A security guard came out from the inside to ask me "Are you taking pictures of the building?". I said yes, and he told me that I wasn't allowed to. I replied, "Isn't this a public space?" and he said "No, it's closed." As I walked away, I peered into the space from the outside windows and indeed the space was closed and blocked off due to renovation. Although the POP was inaccessible, was the guard correct in telling me that I could not take pictures of the building?

Thank you for your comment. Owners are allowed to impose reasonable rules in their POPS. Prohibiting you from sitting or eating does not sound reasonable. We may be in touch with the owner and will post a response if we obtain one. Feel free to let us know anything more about your use of the space.

Yesterday after Moral Mondays NYC I was asked to leave a privately owned public space because I was trespassing. Public space is for the people. The security was menacing and mean.
